Warranty Terms of Rüegg Cheminée Schweiz AG 

1. Statutory warranty

Rüegg Cheminée Schweiz AG (hereinafter “Rüegg”) grants the purchaser the statutory warranty in accordance with Art. 197 et seq. of the Swiss Code of Obligations. The warranty period is 24 months from the date of delivery or from the date of service provided by Rüegg employees.

 

A prerequisite for all claims (including statutory warranty) is that:
- the system was operated in accordance with the operating instructions,
- the permitted amount of wood fed was observed,
- installation was carried out by a qualified specialist company.

 

Excluded from the warranty, to the extent permitted by law, are:

- Parts exposed to fire (e.g.combustion chamber linings, grates, seals, insulation materials)

- Glass damage, in particular glass breakage

- Paint damage, in particular caused by cleaning agents or aggressive surroundings

- Damage resulting from improper use, overheating or lack of maintenance

- Consequential damage caused directly or indirectly by the system

- Damage or functional limitations arising from defective external influences (for example unfavourable draught conditions in the chimney < 10 Pa or > 20 Pa)

 

Within the framework of the statutory warranty, Rüegg has the right to choose between price reduction, rescission or replacement delivery.

2. Voluntary additional warranty upon warranty registration

End customers can register a warranty online via the Rüegg website within 30 days of commissioning. Upon successful registration and full compliance with all conditions set out under section 1, Rüegg may, at its own discretion, grant the following voluntary warranty benefits:
- 5-year warranty on fireproof linings
- 10-year warranty on the main body of the heater

 

These benefits are a voluntary gesture of goodwill and may be revoked at any time. They apply exclusively where compliance with all requirements can be proven.

3. Dispute resolution

In the event of disagreement as to whether a defect exists or what caused it, the customer is free, at their own expense, to obtain an independent expert opinion (e.g. from a recognised specialist company or expert). If this opinion concludes that the defect is attributable to Rüegg, then:
- the costs of the expert opinion will be reimbursed, and
- rectification of the defect will be carried out or replaced at our expense.

4. Warranty services

In the event of a warranty claim, depending on the legal basis, rectification, replacement or a statutory legal consequence (price reduction, rescission) shall apply. There is no entitlement to compensation or reimbursement. Warranty services do not extend or suspend the applicable time limits.

5. Deviations

Deviations from these terms are valid only with the written consent of Rüegg. The buyer’s general terms and conditions do not apply..

6. Partial invalidity

If one or more provisions of these warranty terms are or become wholly or partially invalid, unenforceable or void, the validity and enforceability of the remaining provisions of the agreement shall in no way be affected. In such a case, Rüegg undertakes to replace the affected provision with a valid and enforceable provision with a comparable economic purpose. The same applies mutatis mutandis in the event that this agreement should contain a lacuna.

7. Governing law and jurisdiction

These warranty terms, the contractual relationships based thereon and any disputes shall be governed exclusively by substantive Swiss law, to the exclusion of conflict of laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

 

For natural persons, jurisdiction lies firstly with the registered office of Rüegg Cheminée Schweiz AG, or secondly with the customer’s place of residence. For legal entities, the sole place of jurisdiction shall be the registered office of Rüegg Cheminée Schweiz AG.
